NOTICE IS HEREBY GIVEN that by order of the United States District Court for the District of Maine (“Court”) dated September 23, 2025 in Case No. 2:25-cv-00018-JAW, that the United States Marshal for the District of Maine, or one of his deputies (“Marshal”), will sell at public sale, the following vessel: F/V “DESPERATE MEASURES II” (O.N. 1111101), a 2001 Calvin Beal 38’ commercial fishing vessel together with her masts, boilers, cables, engines, machinery, electronics, fishing permits, tackle, traps, appurtenances, etc. (“Vessel”).

Date and Time of Sale: Friday, October 24, 2025, at 11:00 AM

Location of Sale: Journey’s End Marina, 19 Front Street, Rockland, Maine

Terms of Sale: All persons will be required to register with the Marshal to bid and must agree to the terms of sale. The Vessel will be sold to the highest eligible bidder at the public sale. The sale is subject to confirmation by the Court. A $5,000.00 deposit (nonrefundable as to the winning bidder) must be paid via bank check or certified U.S. funds made payable to the U.S. Marshals Service as a qualification to bid. The winning bidder will be required to enter into a purchase and sale agreement with the Marshal at the conclusion of the sale. The balance of the purchase price shall be paid to the Marshal via bank check or certified U.S. funds within 5 business days of the conclusion of the sale. The minimum bid is $5,000. Machias Savings Bank has the right to bid without paying a deposit, and it may credit bid the amount of its preferred maritime lien. The method, order of sale, and bidding increments are at the discretion of the Marshal. Following confirmation of the sale by the Court, the Marshal will provide the successful bidder with a bill of sale for the Vessel. The Vessel will be sold by the Marshal “AS IS” “WHERE IS” and “WITH ALL FAULTS.” There is no warranty relating to title, possession, quiet enjoyment, or the like in this disposition. The successful bidder must take possession of the Vessel within 7 days after confirmation of the sale by the Court. Persons attending the public sale or inspecting the Vessel do so at their own risk and will be required to sign a release holding the United States, the Marshal, Machias Savings Bank, Central Maine Auction Center, Journey’s End Marina, their deputies, agents, employees, agents and attorneys harmless from any liability, including for a released party’s negligence. Other terms may be announced at the public sale, which could include changes to these terms as published.
